Privacy Policy
1. Introduction
Maverrick Network LLC, a Pennsylvania limited liability company, doing business as Blueamber ("Blueamber," the "Company," "we," "us," or "our") respects your privacy and is committed to protecting the personal information you entrust to us. This Privacy Policy describes how we collect, use, disclose, retain, and safeguard personal information when you visit our websites, including blueamber.io, blueamber.realestate, blueamber.ai, and their respective subdomains (collectively, the "Sites"), or when you use our web and mobile applications, products, tools, and related services (together with the Sites, the "Services").
Please read this Privacy Policy carefully. By accessing or using the Services, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with our practices as described herein, please do not use the Services. This Privacy Policy is incorporated into, and forms part of, our Terms of Service.
2. Scope of This Policy
This Privacy Policy applies to personal information that Blueamber processes as a controller (or an equivalent designation under applicable law) in connection with the Services. It does not apply to: (a) information processed by third-party websites, applications, or services that may link to or be accessible from the Services, which are governed by their own privacy policies; (b) information about our employees, contractors, and job applicants; or (c) information that we process solely on behalf of, and at the direction of, our business customers, in which case the business customer's privacy policy governs and Blueamber acts as a service provider or processor pursuant to a written agreement.
3. Information We Collect
3.1 Information You Provide to Us
We collect personal information that you voluntarily provide when you use the Services, including:
- Account and registration information, such as your name, email address, telephone number, password, professional role (for example, real estate agent, investor, lender, or borrower), and account preferences.
- Profile information, such as your photograph, company or brokerage affiliation, professional license number, and biographical details you choose to provide.
- Financial and lending-related information, where you use our lending marketplace or financing features, such as income information, asset and liability information, loan preferences and inquiries, and information about properties you own or intend to purchase.
- Property and transaction information that you input or upload, such as property addresses, purchase prices, rental income, operating expenses, renovation budgets, and investment criteria.
- Communications, such as messages you exchange with other users through the Services, requests you submit to our support team, survey responses, and feedback.
- Payment information, such as billing name and address. Payment card details are collected and processed directly by our third-party payment processors; we do not store complete payment card numbers.
3.2 Information We Collect Automatically
When you access the Services, we and our service providers automatically collect certain information, including:
- Device and usage information, such as your Internet Protocol (IP) address, browser type and version, operating system, device identifiers, referring URLs, pages viewed, features used, links clicked, and the dates and times of your visits.
- Approximate location information inferred from your IP address.
- Cookies and similar technologies, as described in Section 8 (Cookies and Tracking Technologies).
3.3 Information We Receive from Third Parties
We may receive personal information about you from third-party sources, including:
- Property data providers, which supply public-records data, listing data, valuation estimates, rental estimates, and comparable-property information that we associate with properties you analyze through the Services.
- Identity-verification and fraud-prevention providers, where verification is required to access certain features.
- Single sign-on providers (such as Google), if you choose to register or log in using a third-party account, subject to the permissions you grant.
- Business partners and other users, such as when another user invites you to collaborate on a transaction or shares a deal with you.
We may combine information collected from these sources with information we collect directly from you.
3.4 Launch Waitlist
Before our products are publicly available, the Sites may show a "coming soon" page where you can ask to be told when we launch (the "Launch Waitlist"). If you join the Launch Waitlist, we collect:
- your email address;
- the date and time you joined, and the version of the notice you agreed to;
- the language of the page you used; and
- where your visit came from, when that is available: the campaign tags in the link you followed (for example, which video or post it was shared in) and the name of the website that referred you.
We use this information to send you emails about our launch, to confirm that the email address belongs to you where we ask you to do so, to keep a record of your agreement, and to understand which of our announcements people respond to. We do not sell or rent Launch Waitlist email addresses.
Launch Waitlist information is stored with our email delivery provider, which processes it on our behalf as described in Section 7. To limit misuse of the sign-up form, we briefly process the IP address of each request in order to limit repeated attempts; we do not store it with your Launch Waitlist record.
You can leave the Launch Waitlist at any time by replying "unsubscribe" to any email we send you, or by writing to unsubscribe@blueamber.io. We keep Launch Waitlist information until you ask us to remove it or until we no longer need it for launch communications, whichever comes first.
4. How We Use Your Information
We use personal information for the following purposes:
- To provide, operate, maintain, and secure the Services, including creating and administering your account and processing your transactions;
- To perform property, deal, and market analyses that you request, including analyses generated with the assistance of artificial intelligence, as described in Section 5;
- To facilitate connections between users of our marketplace features, such as connecting prospective borrowers with participating lenders, at your direction;
- To communicate with you about the Services, including service announcements, security alerts, and administrative messages;
- To send you emails about our launch if you joined the Launch Waitlist, as described in Section 3.4;
- To send marketing and promotional communications, where permitted by law, from which you may opt out at any time;
- To personalize your experience and to develop, improve, and test our products, services, and features;
- To monitor and analyze usage, trends, and activities in connection with the Services;
- To detect, investigate, and prevent fraudulent, unauthorized, or illegal activity, and to protect the rights, property, and safety of Blueamber, our users, and others;
- To comply with applicable legal, regulatory, and contractual obligations, and to enforce our Terms of Service and other agreements.
5. Artificial Intelligence and Automated Decision-Making
Certain features of the Services use artificial intelligence and machine-learning technologies ("AI Features") to generate analyses, estimates, summaries, and recommendations — for example, automated investment analyses of properties you submit. In connection with the AI Features:
- Outputs generated by AI Features are informational tools intended to support, not replace, your own judgment and professional advice. They are estimates and analyses, not guarantees, appraisals, or offers of credit.
- We do not use AI Features to make decisions that produce legal or similarly significant effects concerning you without human involvement. If our practices change, we will provide any pre-use notices and opt-out rights required by applicable law, including regulations governing automated decision-making technology.
- We do not permit third-party AI providers to use your personal information to train their general-purpose models without your consent.
6. Legal Bases for Processing
Where the laws of the European Economic Area, the United Kingdom, or other jurisdictions requiring a legal basis for processing apply, we process personal information on the following bases: (a) performance of a contract, where processing is necessary to provide the Services you have requested; (b) legitimate interests, such as securing and improving the Services, preventing fraud, and marketing our products, where those interests are not overridden by your rights and freedoms; (c) consent, where you have provided it, which you may withdraw at any time; and (d) legal obligation, where processing is necessary to comply with applicable law.
7. How We Share Your Information
We share personal information in the following circumstances:
- Service providers. We share information with vendors and service providers that perform services on our behalf, such as cloud hosting, data analytics, property-data services, payment processing, customer support, identity verification, and email delivery. These providers are contractually restricted from using personal information for purposes other than providing services to us.
- Other users, at your direction. When you use collaborative or marketplace features — for example, submitting a financing inquiry to lenders, sharing a deal analysis, or messaging another user — the information you choose to submit is shared with the receiving users.
- Affiliates. We may share information with our corporate affiliates, consistent with this Privacy Policy.
- Business transfers. We may disclose information in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or a portion of our assets, subject to reasonable confidentiality protections.
- Legal and safety purposes. We may disclose information where we believe disclosure is required by law, subpoena, or legal process, or is reasonably necessary to protect the rights, property, or safety of Blueamber, our users, or the public, or to detect and prevent fraud or security issues.
- With your consent. We may share information for other purposes with your consent or at your direction.
- Aggregated and de-identified information. We may share aggregated or de-identified information that cannot reasonably be used to identify you, and we commit to maintaining such information in de-identified form and not attempting to re-identify it, except as permitted by law.
We do not sell personal information for monetary consideration, and we do not share personal information for cross-context behavioral advertising as those terms are defined under applicable United States state privacy laws.
8. Cookies and Tracking Technologies
We and our service providers use cookies, pixels, local storage, and similar technologies to operate the Services and to collect the usage information described in Section 3.2. These technologies fall into the following categories:
- Strictly necessary technologies, which are required for core functionality such as authentication, session management, and security;
- Functional technologies, which remember your settings and preferences;
- Analytics technologies, which help us understand how the Services are used so that we can improve them.
On our main website we may count visits with an analytics service provided by our hosting provider that does not use third-party cookies. It identifies a visitor by a hash created from the request, and that visitor session is discarded after 24 hours. Before the address of a page you visited is recorded, we remove everything from it except the page path and the campaign tags described in Section 3.4.
Where you allow analytics, or where the law permits it by default, we also use Google Analytics, a service provided by Google, to measure how the Services are used. It is not loaded until then, it is never used for advertising, and you can turn it off at any time in our cookie settings.
You can manage cookies through your browser settings, including blocking or deleting cookies; however, disabling strictly necessary cookies may impair the operation of the Services. Where required by law, we will request your consent before deploying non-essential cookies and will honor opt-out preference signals as described in Section 11.4. Additional detail about the specific cookies and similar technologies we use is provided in our Cookie Policy, available on the Sites.
9. Data Retention
We retain personal information for as long as reasonably necessary to provide the Services, to comply with our legal and regulatory obligations, to resolve disputes, and to enforce our agreements. The criteria we use to determine retention periods include: the duration of your relationship with us and your use of the Services; whether retention is required or advisable under applicable law (for example, for tax, accounting, or recordkeeping obligations); the sensitivity of the information; and whether retention is appropriate in light of applicable limitation periods. When personal information is no longer required, we delete it, de-identify it, or securely archive it in accordance with our data-retention schedule.
10. Data Security
We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, and destruction. These safeguards include encryption of data in transit and at rest, role-based access controls, network and infrastructure security controls, secrets management, logging and monitoring, and periodic review of our security practices. No method of transmission over the Internet or method of electronic storage is completely secure, however, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials and for notifying us promptly of any suspected unauthorized access to your account.
11. Your Privacy Rights and Choices
11.1 Choices Available to All Users
You may access, review, and update most of your account information at any time through your account settings. You may opt out of marketing emails by using the unsubscribe link or instructions contained in each message; you will continue to receive transactional and administrative messages relating to the Services.
11.2 United States State Privacy Rights
Depending on your state of residence, you may have some or all of the following rights with respect to your personal information: (a) the right to know and access the personal information we have collected about you; (b) the right to delete personal information we have collected from you; (c) the right to correct inaccurate personal information; (d) the right to data portability; (e) the right to opt out of the sale or sharing of personal information, of targeted advertising, and of certain profiling or automated decision-making; (f) the right to limit the use of sensitive personal information; and (g) the right to non-discrimination for exercising your rights.
To exercise these rights, contact us at legal@blueamber.io or through the mechanisms provided within the Services. We will verify your request using information associated with your account, such as your email address, and may request additional information where reasonably necessary to confirm your identity. You may designate an authorized agent to submit requests on your behalf, subject to proof of authorization and verification requirements permitted by law. We will respond to verifiable requests within the timeframes required by applicable law (generally 45 days, subject to permitted extensions). If we decline to act on your request, you may appeal our decision by contacting us at the address above with the subject line "Privacy Appeal."
The categories of personal information we have collected in the preceding 12 months, the sources of that information, the purposes for collection, and the categories of recipients are described in Sections 3, 4, and 7 of this Privacy Policy.
11.3 Rights in the European Economic Area, United Kingdom, and Other Jurisdictions
Where applicable law provides, you may have the right to request access to, rectification of, or erasure of your personal information; to restrict or object to its processing; to data portability; and to withdraw consent at any time without affecting the lawfulness of processing based on consent before withdrawal. You also have the right to lodge a complaint with your local data protection supervisory authority.
11.4 Do Not Track and Opt-Out Preference Signals
Where required by applicable law, we honor browser-based opt-out preference signals, such as the Global Privacy Control (GPC), as a valid request to opt out of the sale or sharing of personal information for the browser or device transmitting the signal. Except as described in this Section, the Services do not currently respond to "Do Not Track" signals.
12. Additional Notice for Lending-Related Services
Certain features of the Services facilitate connections between prospective borrowers and participating lenders. Where Blueamber's activities are subject to the Gramm-Leach-Bliley Act and its implementing regulations, nonpublic personal information collected in connection with those activities is collected, used, and disclosed in accordance with the privacy notice provided at the time you establish the applicable relationship, and you will be offered any opt-out rights required by law with respect to sharing with non-affiliated third parties. Participating lenders are independent entities and are responsible for their own compliance with applicable financial privacy laws with respect to information you submit to them.
13. International Data Transfers
The Services are operated from the United States, and personal information is processed and stored in the United States and in other jurisdictions where we or our service providers operate. These jurisdictions may not provide the same level of data protection as your home jurisdiction. Where required by applicable law, we implement appropriate safeguards for cross-border transfers of personal information, such as standard contractual clauses approved by the relevant authorities.
14. Children's Privacy
The Services are intended for individuals who are at least 18 years of age. We do not knowingly collect personal information from children under the age of 18. If we learn that we have collected personal information from a child under 18, we will delete that information promptly. If you believe a child has provided us with personal information, please contact us using the information in Section 17.
15. Third-Party Websites and Services
The Services may contain links to, or integrations with, third-party websites, products, and services that we do not control, including lender websites, property-listing sources, and payment processors. This Privacy Policy does not apply to those third parties, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of any third-party services you use.
16. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or the Services. If we make material changes, we will notify you by posting the updated Privacy Policy on the Sites with a revised effective date and, where required by law, by providing additional notice (such as by email or in-app notification) or obtaining your consent. Your continued use of the Services after the effective date of an updated Privacy Policy constitutes your acknowledgment of the updated terms.
